The phrase Nurse Practice Act should make you pause. Canada has no single statute with that name. Nursing regulation is a provincial and territorial responsibility, so the applicable law depends on where the nurse is registered and practising. A safe legal decision asks four linked questions: What jurisdiction governs? What act is being considered? What gives this nurse authority to perform it? Does the nurse have the competence and practice conditions to do it safely? An employer’s routine, a colleague’s instruction or a client’s request cannot replace those checks. This matters clinically because an unlawful or unsupported action can harm a client even when the intention is helpful. A nurse may have the general scope to perform a procedure but still lack a valid order, directive, delegation or other authorizing mechanism. Conversely, a procedure may be legally available to the profession but inappropriate for that nurse because the nurse lacks current knowledge, skill, judgment, supervision or equipment.
